The Plaintiffs filed suit against the Sheriff and the Chief Deputy for violation of their Civil Rights under §1983. The Plaintiffs had a surveillance camera which monitored their home unknown to the Sheriff. The Sheriff and Deputies came to the neighborhood pursuant to a 911 call looking for a peeping Tom and while there, they broke into the Plaintiff’s SUV with a slim jim and broke into the house and arrested Mr. Merriner who was in the bed. Plaintiff’s alleged false arrest, false imprisonment, malicious prosecution, assault and battery, and violation of civil rights. There was no warrant. The case was settled on confidential basis prior to trial.
